문체부 여행사 지원사업 특혜 논란…중소 여행사들 행정소송

"여행업협회에 100억짜리 사업 전권 위임…서울·대형 여행사들 혜택"

(서울=연합뉴스) 황재하 기자 = 문화체육관광부가 100억원을 들여 여행사들을 지원하는 사업을 하면서 민간 사업자단체인 한국여행업협회에 사실상 집행 권한을 넘겨 특혜를 줬다는 이유로 법적 분쟁에 휘말렸다.

31일 법조계에 따르면 중소 여행사 '이엘'과 '데이아웃'은 "국내여행 조기예약 할인상품 지원 사업을 취소하라"며 최근 한국여행업협회와 문체부를 상대로 서울행정법원에 소송을 냈다.

양사는 소송과 함께 사업에 대한 집행정지도 신청했다.

원고 측은 "문체부가 아무런 법적 근거도 없이 단순한 민간 사업자단체에 불과한 한국여행업협회에 지원사업 설계와 진행에 관한 전권을 위임하고 예산 집행 권한을 일임했으며, 전체 사업 예산 100억원 가운데 10억원을 시스템 구축 비용 명목으로 지급했다"고 주장했다.

문체부의 '국내여행 조기예약 할인상품 지원' 사업은 신종 코로나바이러스 감염증(코로나19) 확산으로 타격을 본 여행업계를 지원하기 위해 마련됐다.

사업을 주관하는 여행업협회가 여행사들을 대상으로 다음 달 10일까지 우수한 국내 상품을 공모하고, 선정된 상품을 개발한 여행사들에 문체부가 총 90억원을 지원한다.

그러나 이엘과 데이아웃은 여행업협회가 전국 2만1천여개 여행사 가운데 2.8%에 불과한 619개사만 가입한 사업자단체인데 특혜를 받고 있다며 반발하고 있다.

원고 측 소송대리인인 박지훈 변호사는 "문체부 담당자와 한국여행업협회 담당자 사이 친분에 근거해 국가 예산 100억원을 집행할 권한을 부여한 것"이라고 비판했다.

양사는 또 여행업협회의 공모 기준도 부적절하다고 주장한다. 여행업협회가 가입사들에 유리한 기준을 세워 다른 여행사들을 사실상 지원 대상에서 배제하려 한다는 것이다.

박 변호사는 "한국여행업협회는 가입된 여행사들 가운데 특히 서울의 대기업 계열 여행사들이 지원 대상으로 선정될 수 있도록 응모 자격과 심사 기준을 작성했다"고 주장했다.

그러면서 "한국여행업협회는 '여행자보험 가입 등 안전대비' 항목에 10점의 점수를 배점했는데, 여행자보험은 여행사 총매출에 비례해 보험료와 보험금이 정해진다"며 "대형 여행사들에 일방적으로 유리한 기준"이라고 지적했다.

또 "지방 여행사와 협업하면 5점의 가산점을 받는데 이는 서울에 있는 여행사들만 대상으로 하는 셈"이라며 "5점의 가산점이 선정 여부를 가를 수 있는 점에 비춰볼 때 서울 여행사들만 염두에 두고 공모한 것으로 볼 수 있다"고 했다.

박 변호사는 "이처럼 서울 지역 대형 여행사들에 혜택이 돌아가도록 한 것은 이 회사들이 한국여행업협회의 실질적 지분권자이기 때문"이라며 "대형 여행사들은 매년 거액의 회비와 기부금을 한국여행업협회에 내고 있다"고 주장했다.

소장을 접수한 서울행정법원은 사건을 행정4부(조미연 부장판사)에 배당했다. 재판부는 다음 달 14일을 집행정지 심문을 열어 양측의 입장을 확인할 방침이다.
